1. Publisher of the Application

The Lumiconte application is published by CODEZIO, a French simplified joint-stock company (SAS) with a share capital of €2, registered with the Montpellier Trade and Companies Register under number 130 419 187, whose registered office is located at 440 Rue de Thomassy, 34090 Montpellier, France.

The application is hosted by Google Cloud (Firebase), Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

2. Purpose and Acceptance of the Terms

These Terms of Use set out the conditions under which the Lumiconte mobile application is made available and may be used. Accessing and using the application constitutes the user's express and unreserved acceptance of these Terms.

3. Access to the Service and Parental Responsibility

The Lumiconte application is intended for children, but its setup, the creation of the user account and the subscription to any paid services must be carried out by an adult (parent or legal guardian).

The account holder undertakes to supervise the use of the application by the minors in their care and is responsible for ensuring compliance with these Terms.

4. Intellectual Property

All elements making up the Lumiconte application (in particular the story texts, illustrations, music, audio files, logos, design and source code) are the exclusive property of CODEZIO and are protected by international copyright and intellectual property laws.

Any reproduction, representation, modification or adaptation of all or part of this content, by any means whatsoever, without prior written permission, is strictly prohibited and constitutes infringement.

5. Subscriptions, Prices and Right of Withdrawal

Access to the full story catalog may require a paid subscription. The applicable prices are those displayed directly in the app stores.

All purchases, billing, automatic renewals and refund requests are handled exclusively by the third-party platforms Apple App Store or Google Play Store. In accordance with the rules of these platforms and the legislation on digital content, the immediate provision of the service after payment entails the waiver of the standard right of withdrawal.

6. Content Created with the Help of Artificial Intelligence

The stories, illustrations and narration voices offered in Lumiconte are created with the help of generative artificial intelligence tools. Each piece of content is then reviewed, selected and, where necessary, reworked by the Lumiconte editorial team before being published in the application, to ensure it is suitable for young audiences.

This content is fiction. It does not depict real people, and no narration voice imitates the voice of an existing person.

No personal data of users, and in particular no data relating to children, is sent to these artificial intelligence tools. The application does not generate any content in real time: all stories are produced in advance and then made available as they are.

7. Personal Data Protection (GDPR)

CODEZIO is committed to respecting the privacy of its users and the confidentiality of their data, in accordance with the General Data Protection Regulation (GDPR). The only data collected is that which is necessary for the application to function (parent account, nicknames and ages of child profiles to tailor the reading, reading progress statistics, subscription management).

No personal data is sold or used for advertising purposes. Only the technical service providers needed to run the service have access to it. Details of this processing and of your rights are set out in our Privacy Policy.

8. Limitation of Liability

CODEZIO uses all reasonable means to ensure continuous, high-quality access to the application. However, the publisher cannot be held liable for service interruptions due to maintenance operations, internet network failures or hardware incompatibilities related to the user's device.

Furthermore, managing the child's screen time remains the sole responsibility of the parent.

9. Changes to the Terms and Governing Law

CODEZIO reserves the right to modify these Terms at any time in order to adapt them to changes in the application or in the law. Continued use of the application after any modification constitutes acceptance of the new Terms.

These Terms are governed by French law. In the event of a dispute and failing an amicable settlement, the French courts shall have sole jurisdiction.
